AN EYEWITNESS to an alleged street rape claimed he saw the victim 'struggling' with her attackers and denied hearing her shout 'give it to me.'

Prosecutors claim that Victor Alvizu, 20, of Green Road, Oxford, and Nestor Macias, 37, of Downside Road, Headington, 'deliberately took advantage' of their drunk victim and raped her.

They both deny one count of rape, one count of attempted rape and a further count of attempted rape, which is an alternative count to the rape charge.

The alleged victim - who cannot be named for legal reasons - said she begged the men to stop and was left screaming and in tears during the street attack on May 4 at Turl Street.

As the trial at Oxford Crown Court continued yesterday a passerby who stumbled across the two men who were with the women in the backstreet took to the witness box to give his account.

He told jurors he saw her 'struggling on the floor' and added: "There were two men on her or around her."

He agreed it was that that made him assume an assault was taking place.

He said: "She seemed to be struggling, I assumed it would be against what was happening.

"I could not see if she was struggling with anything in particular but she was certainly struggling."

He was also asked during cross examination if he had heard the woman shout 'give it to me.'

The man said he did not but when asked if at first the sounds were 'pleasurable noises' of someone having sex he said: "At that stage that did cross my mind."

Jurors were told that after the passerby arrived the two accused men left and the police were then alerted to an alleged attack.

The men deny all the charges and the trial continues.
